Terms of Service

These Terms of Service (the "Terms") are an agreement between you and [Operator legal name], [Registered address] ("AI Story Kit", "we", "us" or "our"). They govern your use of the website at aistorykit.app and everything offered on it (the "Service").

Please read them together with our Privacy Policy and Refund Policy, which form part of these Terms.

Acceptance of these Terms

By accessing or using the Service, with or without an account, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization.

Definitions

  • Account means the account you sign in to with Google.
  • Prompts means everything you type or choose in the Service: story ideas, character names and descriptions, settings and edits.
  • Output means the stories, illustrations, character images, narration and videos the Service creates from your Prompts.
  • Your Content means your Prompts and your Output together.
  • Credits are units that meter use of the Service. The number of credits each action uses is shown on the Pricing page and before you confirm a job.
  • Daily free stories are the stories you can write each day without using credits.
  • Plan means a monthly or annual subscription, and Credit Pack means a one-time purchase of credits.

Who can use the Service

You must be at least 18 years old to use the Service, with or without an account. By using it you confirm that you are.

Stories for children are meant to be created by a parent, guardian, teacher or other adult. You decide whether a story is suitable before you read or share it with a child. Children should not use the Service themselves. We may close any account we reasonably believe belongs to someone under 18.

The Service

AI Story Kit writes stories from your ideas with AI. It can also illustrate a story as a picture book and turn it into a video.

  • Stories: you give an idea and choose settings such as genre, length and audience, and the Service writes the story. You can continue or rewrite it.
  • Storybooks: the Service illustrates your story page by page and creates character images to keep characters consistent.
  • Story videos: the Service can turn a storybook into a narrated video with subtitles, or create a story video from AI-generated video clips.

Free and paid use

  • Without an account: you can write a few short or medium stories each day. You cannot create illustrations or videos, and stories are not saved.
  • Free account: you get more daily free stories and some free daily credits for illustrations. Illustrations and videos made on a free account may carry a watermark.
  • Paid use: a Plan or a Credit Pack adds credits, story videos made from AI video clips, output without a watermark and longer storage.

The current allowances and credit costs are shown on the Pricing page. We may change features and limits to keep the Service working well. If a change takes away something you have already paid for, it will not apply to you until your current billing period ends, or we will offer you a pro-rata refund.

AI providers

The Service uses third-party AI providers to generate text, images, speech and video. We send them your Prompts, and images the Service has already made for you, so they can create the Output. See our Privacy Policy for details.

Accounts

Accounts are created by signing in with Google. An account is required to create illustrations or videos and to buy a Plan or Credit Pack.

You are responsible for activity on your account and for keeping access to your Google account secure. Tell us at [email protected] if you think someone has used your account without permission.

Free stories and free credits are meant for one person. Do not create multiple accounts, clear your browser or use scripts, proxies or other tricks to collect extra free use. We use automated checks to enforce this, and we may limit or close accounts that break this rule.

Credits, plans and payments

Credits

  • The credits an illustration, storybook or video will use are shown before you confirm it, and they are deducted when the job starts.
  • Short and medium stories use your daily free stories first. After that, each one uses credits. Long stories always use credits.
  • If a job fails, its credits are returned to your account automatically. Story videos are made in segments, and if one segment fails, the credits for that segment are returned.
  • A narrated storybook video is charged on its estimated length. If the finished video is shorter than estimated, the difference is returned.
  • If our content filter blocks a result, the credits for it are returned.
  • Daily free stories and daily free credits refresh 24 hours after you claim them. Unused ones do not carry over.
  • Plan credits are issued each billing month, including on annual billing, and expire at the end of that month.
  • Credit Pack credits stay valid for 12 months from the date of purchase.
  • Credits have no cash value. They cannot be exchanged for money except as described in our Refund Policy, and cannot be sold, transferred or moved to another account.

Plans

Plans are billed in advance, monthly or yearly, and renew automatically at the then-current price until you cancel.

You can cancel at any time from your account page. Your Plan stays active until the end of the period you have paid for and does not renew after that.

Credit Packs

Credit Packs are one-time purchases. They do not renew and there is nothing to cancel.

The paid features that come with a Credit Pack apply only while the pack has credits left, has not expired and has not been refunded.

Payments and prices

Payments are processed by Stripe, and by buying you also agree to Stripe's terms for the payment. Prices are shown in US dollars on the Pricing page and may include or be subject to taxes depending on where you live.

We may change prices. A new price applies to a Plan from its next renewal after we have told you about it, and never to a period you have already paid for.

If a payment fails or is reversed, we may pause paid features until it is settled. Please contact us before opening a chargeback so we can try to resolve the problem.

Refunds

Credits from a failed job are returned automatically. A Plan payment, including a renewal, or a Credit Pack can be refunded in full within 7 days of the charge if none of the credits it added have been used. Once a payment is refunded, the period it paid for ends.

The full rules and how to ask for a refund are in our Refund Policy. Nothing in these Terms limits refund rights you have under consumer law.

Your content

You keep all rights to your Prompts. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process and display Your Content only as needed to run the Service for you. For example, we send Prompts to our AI providers, add a watermark to free output and show you previews. This license ends when Your Content is deleted, except for copies we must keep by law.

We do not use your stories, prompts or images to train AI models. We do not claim ownership of your Output. As far as we have any rights in it, we assign them to you.

The law on who owns AI-generated material is still developing, and in some countries Output may not be protected by copyright at all. Other people may receive similar Output from similar prompts.

By using the Service, you confirm that:

  • you have the right to use everything you put into a Prompt;
  • you only include personal details about real people, including children, where you have the right to share them; and
  • your Prompts and your use of the Output do not break any law or anyone else's rights.

Fanfiction and existing characters

You can write stories that use characters, settings or worlds created by someone else. Those characters and worlds belong to their owners. We do not have permission from those owners, and these Terms do not give you any.

You are responsible for how you use and share fanfiction and other stories based on existing works. Rules differ by country and by how you use a story; sharing a fan story for free is treated differently from selling it. Many publishing platforms and fan archives also have their own rules about AI-generated work. Check them before you post.

If a rights holder complains about content made with the Service, we may remove it as described under "Copyright complaints" below.

Acceptable use and prohibited content

Use the Service only for lawful purposes and in line with these Terms. Fictional conflict, danger and scary themes are fine in stories. You must not use the Service to create, request or share:

  • Content involving minors: anything that sexualizes, exploits or endangers minors, including fictional characters who are or appear to be under 18. This is absolutely forbidden and will be reported to the National Center for Missing & Exploited Children (NCMEC) and other authorities.
  • Sexual content: pornographic or sexual material of any kind, including in romance stories and fanfiction.
  • Harm to real people: content that harasses, bullies, threatens, humiliates or defames a real person, for example a story written to mock a classmate or coworker, or sexual or degrading content about any real person.
  • Hate: content that promotes hatred of, or violence against, people because of who they are.
  • Real-world harm: content that promotes or gives instructions for violence, terrorism, self-harm, suicide, weapons, illegal drugs or other dangerous acts, even when it is framed as a story.
  • Infringing content: copies of substantial parts of books, scripts, lyrics or artwork you do not have the right to use.
  • Deception: Output presented as true events or as news, Output used to impersonate someone or commit fraud, and Output submitted as your own work where the rules require you to disclose AI use, such as some schools and publishers.
  • Illegal content: anything else that breaks the law where you live or where the Service operates.

You also must not:

  • write prompts designed to get around our content filters;
  • access the Service through bots, scrapers or unofficial clients, or overload its infrastructure;
  • bypass watermarks, usage limits, security checks or payment;
  • probe, attack or reverse engineer the Service or the models behind it;
  • resell or provide the Service to others as your own product without our written permission.

Content filters

We check Prompts and Output with automated filters. A filter may refuse a request or hold back a result. Filters are not perfect: they can block something harmless, and they can miss something that breaks these rules.

We do not read every story, but we may inspect, block or remove content and suspend or close accounts that we reasonably believe break these rules, without returning credits used in the violation. We may report illegal content and share related account information with law enforcement where the law requires it.

About AI-generated output

AI Story Kit creates fiction with AI. Output can be wrong, odd or inconsistent:

  • Stories can contain made-up or incorrect facts, names, dates and places, even when you ask for something factual.
  • Illustrations and videos can contain mistakes, such as wrong hands, garbled text or a character that looks different from one page to the next.
  • Output can resemble existing books, characters, artwork or real people by chance. We cannot promise that any Output is original or free of other people's rights.
  • Our filters reduce the chance of unsuitable content but cannot guarantee that a story is right for a particular child or reader.

Check Output before you rely on it, publish it, sell it or share it with a child. Output is not professional, educational, medical or legal advice, and it must not be used as evidence or as a record of real events.

File storage

Stories, illustrations, narration and videos stay in your library for 7 days on a free account, and for 180 days on an account with a Plan or a Credit Pack. You can delete an item earlier from your library. Stories written without an account are not saved.

The Service is not a backup or storage service. Download anything you want to keep, because deleted items cannot be recovered.

Our intellectual property

The Service, including its software, design, text, graphics, example stories, logo and the AI Story Kit name, belongs to us or our licensors and is protected by intellectual property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service as intended. They do not transfer any of our rights to you. If you send us feedback or suggestions, we may use them freely without paying you.

Copyright complaints

If you believe content made with the Service infringes your copyright, email [email protected] with:

  • your contact details;
  • a description of the work;
  • information that lets us locate the content, such as a link or account details;
  • a statement that you believe in good faith the use is not authorized; and
  • a statement, under penalty of perjury, that your notice is accurate and that you own or are authorized to act for the owner of the right.

We will remove infringing content and close the accounts of repeat infringers where appropriate.

Third-party services and links

The Service relies on third parties, such as Google for sign-in, Stripe for payments and AI providers for generation, and it may link to other websites. We do not control those services and are not responsible for their content, policies or practices. Your use of them is governed by their own terms.

Suspension and termination

You can stop using the Service at any time, and you can ask us to delete your account at [email protected].

We may suspend or close your account, with or without notice, if you break these Terms, if we are required to by law, or if your use puts the Service or other users at risk. If we close an account in good standing for another reason, we will refund the unused part of any Plan or Credit Pack.

When your account is closed, your right to use the Service ends and your library and unused credits are deleted. Sections that by their nature should survive continue to apply. These include the sections on your content, intellectual property, disclaimers, limitation of liability, indemnity and governing law.

"As is" and "as available" disclaimer

To the maximum extent permitted by law, the Service and all Output are provided "AS IS" and "AS AVAILABLE", with all faults and without warranties of any kind, whether express, implied or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not promise that the Service will meet your requirements, produce any particular result or quality, be available without interruption, or be free of errors, viruses or other harmful components, or that errors will be corrected.

Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you. In that case they apply to the greatest extent the law allows.

Limitation of liability

To the maximum extent permitted by law, AI Story Kit, its affiliates, suppliers and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages. This includes any loss of profits, revenue, data, goodwill or business opportunities arising out of or related to your use of, or inability to use, the Service or any Output, even if we have been told such damages are possible.

Our total liability for all claims related to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud, or for death or personal injury caused by negligence.

Indemnification

You agree to defend and indemnify AI Story Kit and its affiliates against claims, damages, losses and expenses, including reasonable legal fees, arising from Your Content, your use of the Service or your breach of these Terms, to the extent permitted by law.

Governing law and disputes

If you have a concern about the Service, please contact us at [email protected] first. Most problems can be solved quickly this way. You agree to try in good faith to resolve a dispute informally for at least 30 days before starting formal proceedings.

These Terms are governed by the laws of [Governing-law jurisdiction], without regard to its conflict-of-law rules. Disputes will be heard by the courts of [Court location], except where the law gives you the right to bring proceedings elsewhere.

For consumers in the European Union and United Kingdom

If you are a consumer living in the EU or the UK, you also benefit from the mandatory consumer protection laws of your country, and you may bring proceedings in the courts where you live.

Because the Service is a digital service that starts as soon as you use it, you agree when you buy that performance begins immediately. If you use credits from a purchase, you lose the statutory right of withdrawal for what you have used. Our Refund Policy still applies.

United States legal compliance

You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

General

  • Entire agreement: these Terms, the Privacy Policy and the Refund Policy are the whole agreement between you and us about the Service.
  • Severability: if any provision is found unenforceable, it will be changed only as far as needed to make it enforceable, and the rest of the Terms stay in effect.
  • No waiver: not enforcing a right does not mean we give it up.
  • Assignment: you may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
  • Force majeure: we are not responsible for delays or failures caused by events beyond our reasonable control, including outages at our hosting, AI or payment providers.
  • Translations: if these Terms are translated, the English version prevails in case of any conflict.

Changes to these Terms

We may update these Terms from time to time. We will post the new version here and change the "Last updated" date.

For material changes, we will give account holders at least 30 days' notice by email or on the Service before they take effect. If you keep using the Service after that, you accept the new Terms. If you do not agree, stop using the Service and cancel any Plan before the changes take effect.
